Update on Insider Dealing (SG and HK) and Hong Kong’s Manager-In-Charge Regime

AIMA and Simmons & Simmons invite you to join our Fund Manager Briefing Session on Insider Dealing and the Manager-In-Charge Regime.   

Insider Dealing – Simmons & Simmons will provide an update on current law and regulation impacting managers in Singapore and Hong Kong and how market participants can manage the related risk. Singapore adopts the “information-connected” approach towards tackling insider trading, and it will be important to market participants operating in both jurisdictions to know when information is not “generally available” under Singapore law lest they be subject to criminal and civil sanction, and how this compares to Hong Kong’s bright-line test for published and public information which is over two decades old and largely ignores access to online information.

Senior management accountability ranks high on regulators' agendas. The session will also discuss Hong Kong’s MIC – now that the first phase of “mapping” is complete what should managers in the asset management industry expect next? It is too early to be certain but the background to the UK Senior Managers Certification Regime, from which the MIC is derived, provides interesting context. We highlight some of the issues which Managers-In-Charge should be thinking about next.
