Update on Insider Dealing and the Manager-In-Charge Regime

 

Insider Dealing – when is information treated as “public”?  The bright-line test for published and public information under Hong Kong law is over two decades old and largely ignores access to online information.  Hong Kong’s approach is unique, it continues to surprise new entrants to the market and is an irritant to its veterans.  Is there a better test?  This session will look at the origins of the current test, ways in which to mitigate risk and explore possible alternatives with which to lobby the SFC.

 

MIC – now that the first phase of “mapping” is complete what should the industry expect next?  It is too early to be certain but the background to the UK Senior Managers Certification Regime, from which the MIC is derived, provides interesting context.  We highlight some of the issues which Managers-In-Charge should be thinking about next.
