AIMA is pleased to announce that we will soon start work on a new guide focused on the practical considerations involved with implementing the soon to be final amendments to various Canadian National Instruments, including but not limited to NI 81-102.

These amendments, which follow on from a September 2016 proposal regarding the “Modernization of Investment Funds Product Regulations – Alternative Funds” are widely expected to become effective as part of a legislative package to be adopted near mid-year.  In anticipation the finalisation of that legislation, AIMA is raising a working group to help prepare a practical implementation guide for AIMA members in Canada, as well as illuminating any practical considerations arising for non-Canadian firms.  The specific content of the guide will be discussed and agreed with members of the working group selected from among those who step forward as volunteers.  We will be aiming to be in a position to publish the guide as promptly as possible following the adoption of the applicable legislation.

This guide will be drafted by members for the benefit of members.  Accordingly, we are seeking volunteers from the membership to participate in this working group.  If you would like to participate, please send an email to Claire Van Wyk Allan by no later than the close of business on Thursday, 20 April 2018 and include: (i) your name, (ii) your company name, and (iii) your experience with Canadian investment funds regulation.  We are seeking sufficient numbers of volunteers that no individual person would need to commit more than 20 hours over the life of the project and would not have to draft more than 3-4 pages of single spaced text.  We will select a working group from among the volunteers with as diverse types of experience as we can.  Non-Canadians are welcome to volunteer, but we will ask you to be more specific in relation to your experience with the Canadian regulatory regime.

If you do not have the time or inclination to participate on the working group but you have ideas about what you think should be covered in this guide, please send any ideas you have to Claire, Uzi Rosha or Jennifer Wood so they can be considered as part of the development of the outline for the guide.
