In the aftermath of the Weinstein scandal and the #MeToo movement, sexual harassment in the workplace has become a topical issue for employers.   

In this session, Sarah Berkeley and Russell Lamb will discuss the legal framework in Hong Kong and the risk of vicarious liability for employers.  They will provide practical advice on how to manage the risk and how to address complaints when they arise.  The session will also look at the use of non-disclosure agreements in the context of sexual harassment complaints, including recent concerns about them being used as a tool to hide sexual misconduct and gag complainants.
