AIMA reacts to Supreme Court BlueCrest ruling, welcoming greater clarity on Salaried Members rules

The UK Supreme Court has today handed down its judgment in the BlueCrest case, providing important clarification on the application of the Salaried Members rules.

AIMA intervened in the BlueCrest case to help address long-standing uncertainty around the Salaried Members rules, which has impacted many AIMA members.

Commenting on the outcome, Paul Hale, Managing Director, Global Tax Policy Advisor at AIMA, said: 

"BlueCrest will be disappointed by today's decision. For the wider industry, however, the judgment provides some much-needed clarity and moves away from the Court of Appeal's narrow interpretation of the Salaried Members rules in several important respects. In particular, the judgment on Condition B (significant influence) appears to provide useful guidance that could help the industry and HMRC reach common ground on its application.

"AIMA intervened in the case because uncertainty over how those rules should be applied affects many of our members, and we saw an opportunity to help secure greater clarity for taxpayers, advisers and HMRC."
